Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of nudegbee.com and the NudgeBee Kubernetes alert triage and remediation platform (the "Service") operated by NudgeBee Private Limited ("the Company," "we," "us," or "our") (78 Outer Ring Road, Bellandur, Bengaluru, Karnataka 560103, India). By creating an account or using the Service you accept these Terms. Nothing in these Terms limits your statutory rights under the laws of your country of residence.

2. The Service and What It Does

The Company provides an AI-assisted platform that ingests Kubernetes cluster telemetry and alert payloads, correlates events to identify the root-cause workload, and proposes a targeted remediation. A core design principle of the Service is that no fix is applied to your cluster without your explicit approval. You retain full control over your cluster at all times. The Service does not and cannot autonomously modify, scale, restart, or delete any workload, pod, or resource in your cluster without a human approval step.

• You must be of legal age in your jurisdiction or have parental or organisational consent to use the Service.
• You agree not to use the Service unlawfully, to interfere with its operation, or to attempt unauthorised access to it or any connected system.
• You may not scrape, reverse-engineer, or copy the Service except as permitted by mandatory law.
• You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

3. Intellectual Property

The Service and all associated software, algorithms, interfaces, and documentation are owned by the Company or its licensors and are protected by international intellectual-property law. We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose of monitoring and triaging alerts on your Kubernetes clusters during the term of your active subscription.

4. Customer Data and Cluster Telemetry

You are responsible for all content and data you connect to or submit through the Service, including cluster telemetry, alert payloads, and workload metadata ("Customer Data"). You grant us a limited licence to use, store, and process Customer Data solely to operate the Service and deliver alert triage results to you. We do not use Customer Data to train or improve our AI models for other customers without your explicit written consent. Our handling of personal information within Customer Data is described in our Privacy Policy.

5. Subscription, Billing, and Free Trial

The Service is available on a subscription basis at the tiers and prices listed on our pricing page. Paid plans (Team at USD 149/month and Scale at USD 399/month) are billed monthly unless you elect annual billing. A 14-day free trial is available for the Team tier; no credit card is required for the Solo free tier. We reserve the right to change pricing with advance notice to existing subscribers. Failure to pay may result in suspension of your account.

6. Disclaimers

The Service is provided on an "as is" and "as available" basis. The Company disclaims all warranties to the maximum extent permitted by applicable law, including warranties of merchantability, fitness for a particular purpose, and non-infringement. In particular, while the Service is designed to identify root causes and propose appropriate remediations, we do not warrant that any diagnosis or proposed fix will be complete, correct, or suitable for your specific environment. Mandatory consumer warranties applicable in your country of residence are not affected.

7. Limitation of Liability

To the maximum extent permitted by applicable law, the Company's total liability for any claim arising from or related to the Service will not exceed the greater of (a) the subscription fees you paid to the Company in the three months immediately preceding the event giving rise to the claim, or (b) USD 100. This limit applies regardless of the form of action and whether the Company was advised of the possibility of such damages. Liability that cannot be limited under mandatory law is not affected.

8. Indemnification

You agree to indemnify and hold harmless NudgeBee Private Limited, its founders, employees, and contractors from any claims, losses, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any third-party right, including any claim arising from a cluster change you approved through the Service.

9. Termination

We may suspend or terminate your access for material breach of these Terms, non-payment, or conduct that poses a risk to the Service or other customers, with or without prior notice depending on the severity. You may cancel your subscription at any time through your account settings. Sections 3, 4, 6, 7, 8, 10, and 11 will survive termination.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Disputes arising out of or in connection with these Terms are subject to the non-exclusive jurisdiction of the competent courts in Bengaluru, India, without prejudice to mandatory consumer-protection rights of your country of residence.

11. Changes and Contact

We may update these Terms. Material changes are posted with a new "Last updated" date. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
